Company (referred to as either “TMV”, “We”, “Us” or “Our” in this Agreement) refers to The Mamahood Village

Client (referred to as “You”, “Your”) the person receiving the services and/or information provided by The Mamahood Village

Overview

By using this website or purchasing a service you are agreeing to The Mamahood Village terms and conditions.

Your access to and use of Our services is conditioned on Your acceptance of and compliance with these Terms and Conditions. By accessing, using or purchasing Our Services You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions, then You may not access the Services.

Your access to and use of Our Services is also conditioned on Your acceptance of and compliance with Our Privacy Policy. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information and when You use Our Website. Please read Our Privacy Policy carefully before using Our Service.

Package support

At The Mamahood Village, Our sole purpose of practice is to provide You with support and education in relation to Your Child(s) sleep. We do not intend to replace medical advice. If You are concerned about a potential medical or nutritional issue related to Your Child(ren) You agree to check and obtain clearance with Your GP or Paediatrician immediately before purchasing a package or at the advice of TMV. We reserve the right to refuse a service if we are concerned for your child/ren’s current health and welfare.

By using Our services, You agree to follow all guidelines relating to safe sleep practices. These guidelines can be found at Red Nose.org- safe sleeping.

For Us to provide You with the best advice and support, You agree that you will only provide Us with accurate information when communicating with Us and will not provide misleading, false or inaccurate information.

You agree that in order to achieve realistic results and expectations You need to commit, follow and implement all the changes recommended within the sleep plan and throughout the support period allocated to Your package. You agree that it is Your responsibility to implement these suggested changes and TMV can only provide You with the support and guidance to achieve this.

TMV will not be liable for anything practiced outside of the suggestions/instructions provided within Your sleep plan or other communications.

​

TMV takes no responsibility for the final outcome as results depend heavily on Your commitment, patience, consistency, and time You allow to implement changes in order to make adjustments.

​

You understand that Your Child’s(ren’s) sleep plan(s) and assessment(s) are specifically tailored for Your individual circumstances and therefore it should not be shared with a third party for use.

​

There is no professional relationship formed between You and TMV unless you explicitly choose to work with me by purchasing one Our services.

 

Purchases

​

By purchasing a package through the website, You warrant that You are legally capable of entering into binding contracts.

​

If You wish to place an order for a package available on the website, You may be asked to supply certain personal information relevant to Your order. By submitting such information, You grant us the right to provide the information to payment processing third parties for purposes of facilitating the completion of Your purchase.

​

Payment is required at the time of an online purchase or 48 hours after receiving an invoice, unless other arrangements have been made.

Package Cancellation and/or refund

​

At TMV We understand that life can sometimes bring Us challenges out of our control. If You require a refund or need to put the package on hold for any reason, We will do our best to work with You and come to a resolution at the discretion of The Mamahood Village

​

Babies and toddlers are constantly changing, with a new stage of development always around the corner. This means when you decide to purchase a package containing a follow-up support period, you must access this within 30 days of receiving your plan for it to remain valid. Failure to do so will result in the expiration of the follow-up support and a repurchase will be necessary.

​

If You need to reschedule a consultation for any reason. 24 hours notice must be provided to Us.

​

If You have to cancel a package within 48 hours of the booking, We will only refund you 50% of the amount of any payment made.

​

A full refund will be provided for cancellations with more than 48 hours notice.

​

If You request a refund after a sleep plan has been provided, You will receive only 20% refund for the remainder of Your package.

​

You will not be eligible for a refund if You choose to cancel or exit a package before the completion date. This includes after a consultation, after a sleep plan has been provided or during the support period.

​

We reserve the right to refuse or cancel Your package at any time for certain reasons including but not limited to:

• Package availability: In this case We will provide you with an option of alternative dates. We understand that these may not suit Your circumstances, so You reserve the right to request a refund.

• Errors in Your purchase: If Your location is outside our service area and an alternative package needs to be arranged

• Errors in the description or prices of packages

• Concerns about the health and welfare of Your child/ren

 

We reserve the right to refuse or cancel Your Order if fraud or an unauthorized or illegal transaction is suspected.

In the unlikely event that You have any complaints about Our packages or services please get in contact as soon as possible so that We can work together to find a resolution.

At TMV We are constantly updating Our website and packages. We do Our best to ensure all information regarding Our packages is correct however due to circumstances out of Our control, We may experience delays in updating information regarding Our packages and in Our advertising on other websites.

The information contained in this Website has been prepared solely for the purpose of providing information about TMV and the packages and services We offer.

​

We cannot and do not guarantee the accuracy or completeness of any information, including but not limited to prices, product images, availability, and services. We reserve the right to change, update or revise information and to correct errors, inaccuracies, or omissions at any time without prior notice. Packages already purchased will not be affected.

TMV trademarks and trade dress may not be used in connection with any product or service without the prior written consent of The Mamahood Village.

The laws of Australia, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

We are not liable to fulfil our obligations if circumstances were to arise beyond Our reasonable control. In no event will TMV be liable of any direct, indirect or consequential injury, damage, losses or expenses arising from Your use of these services or this website.

Feedback

If an image, comment or review is submitted directly to Us, We will receive that submission as authorisation to Use that image, comment or review on Our website, or in Our Social Media platforms. You agree that We may, at any time, without restriction, edit, copy, publish, distribute, translate any comments that You forward to us. We are and shall be under no obligation to maintain any comments in confidence; to pay compensation for any comments; or to respond to any comments. We take no responsibility for how others choose to share, comment on or engage after We have posted, however We may under no obligation to, monitor, edit or remove content that violates any party’s intellectual property or Our terms and conditions.
